A. Terms of Use for Viewing 3D Virtual Exhibition Tours and 3D Artspaces
1. Agreement
By accessing or viewing a V21 Artspace 3D Virtual Exhibition Tour or 3D Artspace, the user accepts these Terms of Use. Any conflicting terms issued by the user are not recognised.
2. User Responsibilities
The user is responsible for their own device, connection and conduct while accessing V21 Artspace content. The user must:
- comply with all applicable laws
- not upload, distribute or submit infringing, harmful or unlawful material
- not disrupt or interfere with V21 Artspace systems or services
We reserve the right to restrict access or remove content where necessary.
3. Prohibited Use
The user must not transmit or display content that is:
- copyrighted without permission
- defamatory, harassing or abusive
- hateful, discriminatory or harmful to children
- pornographic or promoting violence
4. Content Monitoring
We may review, edit, block or remove content that may violate these terms or applicable law. We are not obliged to publish any user-submitted material.
5. Copyright and Intellectual Property
All V21 Artspace websites, virtual exhibition spaces, 3D environments and related assets are protected by copyright.
- Users may not reproduce, download, scrape, archive or print any part of a V21 Artspace environment without explicit written consent.
- By submitting any content for inclusion (e.g. wall texts, media, metadata), the user confirms they have the right to do so and that V21 Artspace will not face claims from third parties.
6. Indemnification
The user indemnifies V21 Artspace against any claims arising from:
- copyright infringement
- data misuse
- breach of these terms
- damage caused by user-submitted content
This includes covering legal costs.
7. Privacy
We comply with all UK data protection regulations. Operational logs (including IP addresses, browser type and usage data) may be stored to ensure system integrity and security. Sensitive or private content is only processed where necessary. See our Privacy Policy for full details.
8. Service Availability
We aim for continuous availability but cannot guarantee uninterrupted service. We are not liable for outages caused by:
- maintenance
- network issues
- server failure
- exceptional loads
- force majeure events
- cyberattacks beyond reasonable protection
Where downtime is planned, notice will be provided where feasible.
9. Limitation of Liability
V21 Artspace is not liable for:
- user-to-user disputes
- losses caused by reliance on 3D representations
- indirect or consequential damages (e.g. lost sales or loss of profits)
Liability is limited to foreseeable losses and does not cover death, personal injury or cases where UK law prohibits exclusion.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will fall under the exclusive jurisdiction of the English courts.
B. 3D Virtual Exhibition Capture – Client Terms and Conditions (Real-Time Capture Services)
1. Agreement
Use of V21 Artspace services constitutes acceptance of these Terms and Conditions. Clients are responsible for reading and understanding them before commissioning work.
2. Copyright
All 3D virtual tours, 3D models, 360 images, video, photography and related materials produced by V21 Artspace are licensed, not sold.
- The licence covers use for marketing the specified space.
- Licence duration is stated in the estimate.
- Additional usage, sublicensing or redistribution requires a separate agreement.
- Matterport Terms of Service apply to Matterport-based content.
3. Marketing Attribution
Unless agreed otherwise, clients must credit "V21 Artspace" wherever the work is displayed or published.
4. Additional Usage
Transferring assets to other agents, projects or commercial services requires an additional licence and fee. V21 Artspace may use produced materials for its own portfolio unless the client requests otherwise in advance.
5. Estimates
Quotes are based on the client's initial brief. Changes to scope, schedule or content may incur additional fees.
6. Payment Terms
- Invoices are due immediately upon delivery unless otherwise agreed.
- New clients may be asked to pay a deposit prior to production.
- Late payments incur a £25 processing fee plus 2% interest per month from 30 days after the invoice date.
- Deliverables are released only after payment is received in full.
7. Scheduling
Clients should provide several days' notice for bookings. We will accommodate urgent work where possible but cannot guarantee availability.
8. Cancellation and Rescheduling
- Less than 48 hours' notice: £100 minimum fee
- On-site cancellation: full appointment cost payable
9. Site Preparation
The space must be fully ready at the photographer's arrival. If the photographer must wait or return:
- Waiting time is billed at £100 per hour
- Additional visits incur a minimum £100 charge
10. On-site Services
Duration varies depending on space and complexity. Client delays outside our control are billed at £100 per hour.
11. Visual Accuracy
While we aim for faithful representation, we cannot guarantee absolute accuracy in:
- colour
- brightness
- scale
- shape reproduction
We accept no liability for decisions or losses resulting from perception differences.
12. Delivery and Archival
- Standard turnaround: approx. 5 working days
- 3D Virtual Tours are hosted on V21 Artspace servers or Matterport cloud
- One-year hosting licence included unless stated otherwise
- Annual hosting renewal: £50 per tour
13. Additional Fees
- Travel fees where applicable
- Hosting licence renewals (£50 annually)
- Additional edits, changes or delays caused by the client
14. Client Representation
The client must approve the interpretation of the brief at the outset. If unavailable, acceptance is assumed based on the photographer's judgement.
15. Indemnification
Clients indemnify V21 Artspace against claims arising from use of the delivered work.
C. 3D Artspace Creation – Client Terms and Conditions (Custom Virtual Gallery / CGI Spaces)
1. Agreement
Commissioning a 3D Artspace constitutes acceptance of these Terms. Clients must review these Terms prior to project commencement.
2. Copyright
All CGI environments, 3D Artspaces and associated assets remain the intellectual property of V21 Artspace.
- Clients receive a licence to display and market their exhibition for the agreed duration.
- Media supplied by the client must be rights-cleared.
3. Media and File Requirements
- All media and exhibition plans must meet technical specifications.
- Final exhibition files must be supplied at least 14 days before production begins.
Late, incorrect or incomplete files may incur additional charges or timeline changes.
4. Scheduling and Cancellation
- Standard lead time: 30 days' notice
- Cancellation within 14 days: 50% fee
- Cancellation within 7 days: 100% fee
5. Delivery and Hosting
- 3D Artspaces are hosted on V21 Artspace cloud servers
- Licence duration: one year unless otherwise agreed
- Hosting renewal: £50 per year per Artspace
6. Public vs Private Content
Unless otherwise specified, 3D Artspaces are publicly accessible. Private/unlisted environments may incur an additional fee.
7. Additional Fees
- Hosting licence renewals
- Late delivery or delays caused by the client
- Changes outside the agreed scope
8. Client Approval
If feedback is not provided within agreed timelines, V21 Artspace's interpretation is deemed approved.
9. Indemnification
Clients indemnify V21 Artspace against claims arising from use of the produced work.
